भारत में संसदीय शासन व्यवस्था है और निसंदेह संसदीय शासन प्रणाली के अंतर्गत राष्ट्रपति एक नाम मात्र की कार्यपालिका प्रमुख होता है। जिसका चुनाव अनुपातिक एकल संक्रमणीय मत प्रणाली द्वारा होता है।
ध्यातव्य : एकल संक्रमणीय मत प्रणाली एक ऐसी मतदान प्रणाली है जिसे श्रेणीबद्ध मतदान के माध्यम से आनुपातिक प्रतिनिधित्व प्राप्त करने के लिए तैयार किया गया है।
राष्ट्रपति के निर्वाचक मंडल में संसद(लोकसभा और राज्यसभा) के निर्वाचित सदस्य के साथ-साथ राज्य विधानसभाओं के निर्वाचित सदस्य भाग लेते हैं। राष्ट्रपति के चुनाव को लेकर अक्सर सवाल पूछा जाता रहा है कि क्या राष्ट्रपति के निर्वाचन को चुनौती दी जा सकती है? राष्ट्रपति के निर्वाचन को चुनौती कहां दी जा सकती है ? आदि..इस आलेख के माध्यम से ऐसे ही सवालों के सटीक और तथ्यात्मक जानकारी प्राप्त करेंगे।

राष्ट्रपति चुनाव और परिणाम की घोषणा हो जाने के बाद क्या इसे चुनौती दी जा सकती है ? तो आपको बात de कि राष्ट्रपति के निर्वाचन के बारे में किसी प्रकार का विवाद होता है या शंकाएं होती है तो उसे चुनौती दी जा सकती है। भारतीय संविधान के अनुच्छेद 71(1) के तहत राष्ट्रपति निर्वाचन को सर्वोच्च न्यायालय में चुनौती दी जा सकती है। निर्वाचन आयोग के समक्ष इस प्रकार की अपील नहीं की जा सकती,इस मामले में केवल सर्वोच्च न्यायालय ही अधिकार क्षेत्र रखता है।
- चुनाव को कौन दे सकता है चुनौती ?
राष्ट्रपति के निर्वाचन में किसी प्रकार का विवाद और शंका उत्पन्न होने पर इसे बारे में चुनाव को चुनौती दी जा सकती है लेकिन निर्वाचन में उम्मीदवार रहे व्यक्ति द्वारा अथवा 20 या इससे अधिक निर्वाचको (निर्वाचक मंडल सदस्यों) द्वारा संगठित रूप से सर्वोच्च न्यायालय में इसे चुनौती दी जा सकती है या अपील की जा सकरी है।
ध्यातव्य: निर्वाचन को चुनौती ऐसा व्यक्ति नहीं दे सकता है जो ना तो उस चुनाव में उम्मीदवार है और नहीं निर्वाचक मंडल का सदस्य है। यह प्रावधान (एन बी खरे बनाम भारतीय निर्वाचन आयोग ए आई आर 1958,सुप्रीम कोर्ट 139) मामले में यह निर्धारित किया गया।
- चुनाव को चुनौती देने की समय सीमा क्या है ?
राष्ट्रपति के निर्वाचन को लेकर किसी प्रकार का विवाद होने पर या किसी प्रकार की शंकाएं होने पर उस चुनाव के खिलाफ सर्वोच्च न्यायालय में अपील की जा सकती है लेकिन इसकी भी एक समय सीमा है । ज्ञात हो कि राष्ट्रपति निर्वाचन परिणाम की घोषणा होने के दिन से 30 दिन के अंदर अंदर इस प्रकार की अपील की जा सकती है उसके पश्चात नहीं।
